Construction matters are mostly defined by long-lasting projects with a high risk of ending in a formalised dispute.
We advise principals, contractors, and other interested parties (such as subcontractors, architects, engineers, other planners, financing institutions, and awarding authorities in tender bid projects) on issues of development, planning, construction and financing. Our activity spans from the drafting of contracts for industrial plants and technical works of every size (e.g. power plants, on- and offshore wind parks, process industries, acquisition of plants and machinery) through the procurement process to legally sound procedures and commissioning.
We at BODENHEIMER HERZBERG are not only familiar with the national framework of construction but also with international instruments, such as FIDIC or the NEC.
This experience helps us to both avoid and conduct any conflict at all steps on the escalation ladder, from negotiations over mediation, dispute boards up to litigation or arbitration. We also frequently secure evidence and handle interim relief matters in domestic and international construction cases. Alongside advising on specific problems, we also offer structured project-related advice and risk management.
